The Difference between Physical Custody and Legal Custody

Legal custody describes which parent is responsible for making big decisions for the child, such as those related to education and healthcare; while physical custody describes where the child is living. Where joint custody is awarded, both parents are responsible for the big decision making. However, both parents must agree to a joint custody arrangement. If the parents cannot agree, the judge makes the decision based on the best interests of the child. It should also be noted that joint legal custody does not mean that the child is with each parent 50% of the time.
